1. Acceptance of Terms

By downloading, installing, accessing, or using Fluid, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. Your continued use of Fluid following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

Fluid is a mobile application designed to help users improve their flexibility and stretching habits. The App provides pre-built and user-created custom stretching routines, timed active sessions with guided stretches, a Fluid Score that measures your consistency, streaks, and stretching volume, a content library of stretches organized by body area and goal, session scheduling and streak tracking, and milestone achievements to mark your progress.

Certain features may be available only to subscribers of Fluid Premium (see Section 5).

3. License Grant & End User License Agreement

The Fluid application is licensed, not sold, to you. Fluid Daily ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, subject to these Terms and Apple's Media Services Terms and Conditions ("Usage Rules"). This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

You may not rent, lease, lend, sell, redistribute, sublicense, reverse-engineer, decompile, disassemble, or create derivative works from the App, its content, or any part thereof. You may not copy, modify, or distribute the App for any purpose without our prior written consent. Any attempt to do so is a violation of the rights of Fluid Daily and its licensors.

You and Fluid Daily acknowledge the following:

Acknowledgement: These Terms constitute an agreement between you and Fluid Daily only, and not with Apple Inc. ("Apple"). Fluid Daily, not Apple, is solely responsible for the App and its content.

Scope of license: The license granted to you is limited to a non-transferable right to use the App on Apple-branded devices you own or control, as permitted by the Usage Rules.

Maintenance and support: Fluid Daily is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty: Fluid Daily is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event that the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.

Product claims: You acknowledge that Fluid Daily, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Fluid Daily, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party beneficiary: You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

4. Account Registration & Anonymous Use

You may initially use Fluid without creating an account. When using the App anonymously, your data is stored on our servers but is not tied to a recoverable account—meaning that if you uninstall the App or switch devices, your data may be lost.

You may optionally create an account using your email address and a password to secure your data and enable cross-device access. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions & Payments

Fluid offers a premium subscription tier ("Fluid Premium") that unlocks additional features. Subscriptions are managed through Apple's in-app purchase system via RevenueCat.

By subscribing to Fluid Premium, you acknowledge and agree to the following: Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same subscription price. You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase. Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.

Refunds for subscriptions are handled by Apple in accordance with their refund policy. Fluid Daily does not directly process payments or issue refunds. For refund inquiries, please contact Apple Support.

6. Health Disclaimer

Important: Fluid does not provide medical advice, diagnoses, or treatment. The App is intended for general wellness and informational purposes only.

Fluid collects certain health-related information—including pain points and health conditions such as arthritis, pregnancy, sciatica, or recent surgery—solely for the purpose of personalizing your stretch recommendations. This information does not constitute a medical assessment.

You should consult a qualified healthcare professional before beginning any exercise or stretching program, especially if you have pre-existing health conditions, are pregnant, or have recently undergone surgery. You use Fluid and perform any stretches or routines entirely at your own risk. Fluid Daily is not liable for any injuries, pain, or adverse health effects resulting from your use of the App.

7. User Content

Fluid allows you to create custom routines, design routine covers, and share session results. You retain ownership of any original content you create within the App.

By creating and sharing content through Fluid, you grant Fluid Daily a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the App solely for the purpose of operating and improving the service.

You agree not to create or share content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable, or that infringes upon the intellectual property rights of any third party. We reserve the right to remove any content that violates these Terms.

8. Intellectual Property

All content and materials available in Fluid—including but not limited to stretching routines, stretch descriptions, images, illustrations, the Fluid Score algorithm, branding, logos, and the overall design and look and feel of the App—are the property of Fluid Daily or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any part of the App or its content without our prior written consent.

9. Account Deletion

You may delete your account at any time from within the App by navigating to Settings > Account > Delete Account. Upon deletion, all personal data associated with your account—including your profile information, session history, custom routines, and Fluid Score—will be permanently and irreversibly removed from our servers.

Please note that account deletion does not automatically cancel any active subscription. You must cancel your Fluid Premium subscription separately through your App Store account settings.

10. Termination

We reserve the right to suspend or terminate your access to Fluid, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behavior, or otherwise acted in a manner that could harm other users or the integrity of the service.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including, without limitation, intellectual property, limitation of liability, and governing law) will survive.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Fluid Daily, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of data, loss of revenue, personal injury, or physical harm—arising out of or in connection with your use of or inability to use Fluid.

Without limiting the foregoing, Fluid Daily total aggregate liability for any claims arising out of or related to these Terms or your use of the App shall not exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim.

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

12. Modifications to Terms

We may revise these Terms from time to time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this document and may notify you through the App or by other reasonable means. Your continued use of Fluid after any changes become effective constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
